Road Wear Terms and Conditions of Use

Please read these Terms and Conditions of Use ("Terms") carefully before using the Road Wear mobile application ("the Application"). By downloading, installing, or using the Application, you agree to be legally bound by these Terms. If you do not agree, do not use the Application.

1. Grant of License

Subject to compliance with these Terms, you are granted a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the Application on Android mobile devices owned or controlled by you, exclusively for personal, non-commercial purposes.

You may not:

• Modify, decompile, reverse-engineer, or attempt to extract the source code of the Application.
• Rent, lease, sell, sublicense, or redistribute the Application to third parties.
• Use the Application for any unlawful purpose or in violation of applicable transportation and traffic safety laws.

2. Pro "Lifetime" Purchase Model (One-Time Payment) & In-App Ads

1. Free Version: The Application provides core capabilities supported by advertising delivered via Google AdMob.

2. Pro License ("Lifetime"): Users may optionally purchase a "Pro" Lifetime pass via a one-time payment. Pro unlocks unrestricted garage capacity, unlimited trip logging, and removes all advertisements.

3. Refund Policy: All payment transactions and refund determinations are handled exclusively and securely by Google Play Store in accordance with official Google Play refund policies. The developer does not process credit cards or store personal financial data.

3. Mandatory Safety & Telemetry Disclaimers

A. Road Safety & Responsible Driving (CRITICAL)

• STRICT PROHIBITION AGAINST IN-MOTION OPERATION: You are strictly prohibited from touching, configuring, typing, or interacting with the Application while your vehicle or motorcycle is in motion. All screen interactions must occur while safely and legally parked.
• DRIVER RESPONSIBILITY: The driver/rider assumes total, exclusive responsibility for maintaining full visual attention on the road, complying with local traffic regulations, and driving safely. The developer disclaims all liability for collisions, traffic citations, bodily injuries, or property damage resulting from driver distraction.

B. Telemetry, Speedometer, and GPS Accuracy

• ESTIMATED DATA: Instantaneous speed, top speed, average speed, altitude, distance traveled, and route renderings are estimates computed from consumer smartphone GPS receivers and motion sensors.
• NOT A REPLACEMENT FOR CERTIFIED INSTRUMENTATION: Accuracy depends on atmospheric interference, device hardware quality, and satellite visibility. Under no circumstances should the Application replace your vehicle's factory-certified, homologated speedometer or odometer.

C. Preventive Maintenance Alerts

• ADVISORY ESTIMATIONS ONLY: Component wear bars and service reminders (oil, brake pads, tires, drive chains, filters) are mathematical approximations based on user-entered mileage or GPS trip logs.
• NOT A PROFESSIONAL MECHANICAL DIAGNOSIS: Wear indicators do not guarantee the physical or operational safety of any mechanical part. You remain solely responsible for performing regular physical inspections and scheduling professional maintenance with certified mechanics in accordance with manufacturer specifications.

4. Disclaimer of Warranties ("AS IS")

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, GPS PRECISION, AND NON-INFRINGEMENT.

5. Limitation of Liability

IN NO EVENT SHALL THE DEVELOPER OF ROAD WEAR BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO TRAFFIC ACCIDENTS, MECHANICAL DAMAGE, DATA LOSS, OR TRAFFIC CITATIONS ARISING OUT OF THE USE OF OR INABILITY TO USE THE APPLICATION.

6. Governing Law

These Terms are governed by and construed in accordance with the applicable laws of the developer's jurisdiction, without regard to conflict of law principles.
